Terms and Conditions of Trade
1. Booking Confirmation
A booking is only considered confirmed once a signed agreement and non-refundable booking fee (usually 50% of the total package price) has been received. Dates are held provisionally for up to 7 days; after this, unconfirmed dates may be released to other clients. Bookings made within 60 days of wedding, terms will be negotiated.
2. Payments & Fees
• A 50% non-refundable booking fee is due at the time of booking.
• The balance is due no later than 14 days before the wedding date. If not paid, any booking fee is forfeited, and the booking will be cancelled.
• Payment methods accepted: Bank transfer, or approved online payment gateways.
3. Cancellation Policy
• Cancellations made more than 60 days before the wedding: The booking fee is forfeited, but no further payment is required.
• Cancellations within 60 days: 50% of the total agreed amount is payable.
• Cancellations within 14 days: 100% of the agreed amount is payable.
• All cancellations must be made in writing.
4. Client Rescheduling
In the event of a postponement due to unforeseen circumstances (e.g., illness, natural disaster, travel restrictions), James will make reasonable efforts to accommodate a new date. If unavailable, the cancellation policy will apply.
5. Travel & Accommodation
• Travel within 75km of Wanganui, NZ is included.
• Weddings requiring air travel, ferries, or overnight stays will incur additional charges, agreed upon in advance.

6. Creative Control & Artistic Style & Discretion Clause
James retains full creative control over the photographic style, editing, and delivery. The Client acknowledges they have reviewed James' portfolio and understand that the delivered images will reflect his unique, evolving artistic style. James retains full creative discretion over which moments are captured and how they are composed and edited. While James will make reasonable efforts to accommodate stylistic preferences discussed in advance, no specific poses or images are guaranteed. Dissatisfaction with aesthetic choices alone does not constitute grounds for contract termination or refund.
7. Image Delivery
• Images will be delivered via online gallery within 6–8 weeks of the wedding date.
• James provides high-resolution JPEG files. RAW files are not released.
• Delivery timelines may vary during peak season but communication will be maintained.

• James retains full copyright of all images.
• Clients receive a personal usage license to print and share images non-commercially.
• Images may be used by James Price for portfolio, website, blog, or promotional purposes. If you wish to keep your photos private, please request this in writing at the time of booking.

James shall not be held liable for cancellations, delays, or non-performance due to circumstances beyond his control (e.g., extreme weather, travel bans, illness, equipment failure).

In such cases, James will make every effort to find a suitable replacement or offer a refund (excluding the booking fee).
10. Limitation of Liability
In the unlikely event of total photographic failure, liability is limited to the refund of all payments made. James is not liable for indirect damages, emotional distress, or consequential losses.
11. Client Cooperation
Clients agree to communicate schedules, logistics, and expectations clearly. Any significant delays or lack of cooperation that impact the ability to capture key moments may affect final image outcomes.
12. Conduct & Safety Clause
The Client acknowledges that James' ability to provide services depends on a safe and respectful environment. Should the Bride, Groom, members of the bridal party, guests, or any other persons present behave in a manner that is difficult, abusive, aggressive, unruly, or otherwise creates a situation that compromises the James' personal safety, wellbeing, or professional ability to deliver services (including the safety of any assistants or subcontractors), James reserves the right to immediately cease work and leave the event. In such circumstances, all fees paid will be forfeited by the Client, no refunds will be issued, and no further correspondence will be entered into.
13. Governing Law
These terms are governed by the laws of New Zealand, regardless of the shoot location. In the event of any dispute, controversy, or claim arising out of or relating to this Agreement, the parties agree to first attempt to resolve the matter amicably through good faith negotiations. If a resolution cannot be reached, the parties agree to submit the dispute to mediation with a mutually agreed mediator before pursuing any further legal remedies. Each party shall bear its own costs of mediation, unless otherwise agreed, and any settlement reached shall be binding.
